Legal and ethical consideration is very important during therapy to protect patient privacy and as a practitioner, it requires us to follow the code of ethics and follow the perspective state that governs privacy and the limits of confidentiality regulated by the laws (U.S. Department of Health and Human Services, 2014). In group therapy, we have to be cognizant that not only does privacy and confidentiality be maintained but, as a clinician, we have to be aware of any member is a potential for harm to himself or others (McClanahan, 2014).

When we hear someone speaking about being in therapy, the first thing that comes to mind is individual therapy. The image evoked is often a quiet and private room with the therapist and the client speaking in complete confidentiality. Patients in this setting are protected by the Health Insurance Portability and Accountability Act (HIPAA) Privacy Rule which provides privacy rights and protections with respect to their information disclosed to the therapist. Because of this strong privacy protection, individuals’ trust in their health care providers is maintained especially where very sensitive information is concerned, such as mental health information (U.S. Department of Health & Human Services, 2014). Group therapy, however, is another powerful curative method of mental health treatment which has grown over the years in practice. Issues of confidentiality are multiplied in group therapy from two people to however many group members are in attendance. The private information revealed to the therapist in individual therapy is shared with the whole group and with no assurance that other group members will keep it confidential. Surprisingly, studies have shown that group members expect that their confidentiality will be completely maintained in group settings which shows there is a lack of understanding about how confidentiality in groups settings is different than in individual therapy (McClanahan, Ph.D., 2014).
The job of the nurse practitioner in mental health care, is to determine which therapies are the most helpful and least harmful for the patient. While individual therapy has many advantages, there are therapeutic factors applied to group therapy which are unique. One of these factors is called the instillation of hope, which is the formation of a belief that with the help of others one can move forward. The faith of the therapist along with the visible evidence of the other group members progressing in treatment, provides hope for change (Wheeler &, 2014). The benefit of visualizing and hearing the other members sharing their own stories, outweighs the risk of fearing a breech in confidentiality. The ethical imperative of the provider is to make sure in individual or group therapy that informed consent is obtained. When group therapy is being recommended, education regarding confidentiality should begin before the start of group sessions. Patients should be informed that the group leader may have to break confidentiality in some circumstances, and these situations should be fully explained. They should also be informed that there are no guarantees that the other group members will maintain confidentiality (McClanahan, Ph.D., 2014). Having chosen an appropriate therapy, and explained the confidentiality properly, the patient and provider have established a bond of trust to begin the healing process.
